Uber and bp pulse general terms and conditions

1. Eligible Uber Driver Customers

1.1 Uber drivers who have taken up the bp pulse x Uber customer offer will be entitled to a number of benefits and rewards. In order to obtain access to these benefits and rewards, the Uber driver must:

(a) have an active bp pulse subscription; and

(b) have completed authentication by pairing their bp pulse account with their Uber account, meaning bp pulse has applied an Uber tag to the driver's account (Eligible Uber Driver Customer)

1.2 If an Eligible Uber Driver Customer stops driving on the Uber platform or is removed from the Uber platform in line with Uber’s Driver Terms, they may lose some or all the benefits associated with having an Uber Driver account linked with their bp pulse account.

2. Limitation of liability

2.1 Insofar as is permitted by law, bp pulse, its agents or distributors will not in any circumstances be responsible or liable to compensate an Eligible Uber Driver Customer, or accept any liability whatsoever, under these terms and conditions, including (without limitation) any such liability arising by virtue of the Eligible Uber Driver Customers’ use of Q-Park Park Lane and Q-Park Pimlico.

2.2 Nothing in clause 2.1 above limits an Eligible Uber Driver Customer’s statutory rights.

3. Data protection and publicity

3.1 Insofar as it is applicable, bp pulse will hold and process an Eligible Uber Driver Customer’s personal information in accordance with the Privacy Notice available on the bp pulse website.

4. General

4.1 bp pulse reserves the right to hold, void, suspend, cancel, or amend the offer (in whole or in part) where it becomes necessary to do so.

4.2 If there is any reason to believe that there has been a breach of bp pulse network terms and conditions, bp pulse may, at its sole discretion, reserve the right to exclude you from participating in the Offer.

4.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

4.4 bp pulse may change these terms and conditions from time to time. Please check bp pulse website for any changes.

4.5 If an Eligible Uber Driver Customer no longer has an active Uber account, they will no longer be eligible for Offer 1 and Offer 2.

Offer 1 Subscription and Discount Rate Offer terms and conditions

1. The Promoter

The promoter is: Chargemaster Limited Ltd (trading as bp pulse), Breckland, Linford Wood, Milton Keynes, Buckinghamshire, MK14 6GY (“bp pulse”).

2. The Term

2.1 This offer will run from 21 May 2024 at 00:01 and close on 31 August 2025 at 23:59 (“the Term”), and shall be subject to availability.

2.2 bp pulse reserves the right to withdraw Offer 1 (as defined below) by providing reasonable prior written notice to the Eligible Uber Driver. The withdrawal will only take effect at the end of the current billing cycle in which notice has been served. The Offer will start for existing Eligible Uber Driver customers upon the first day of their next billing cycle. New Eligible Uber Driver Customers will automatically become eligible as soon as their subscription is active, and their Uber status is validated.

3. The Offer (Offer 1)

3.1 Throughout the Term, and subject to these terms and conditions, the Eligible Uber Driver Customer will receive a free bp pulse subscription (the Subscription) (saving £7.85 per monthly billing cycle) and a discount on charge rates (in the form of a monthly bill credit) (the Discount Rate) (together, the Offer 1).

3.2 The Discount Rate is applied to total kWh charge consumption using the paid-for UK bp pulse owned public charging network per monthly billing cycle, and will vary depending on the type of paid-for UK bp pulse owned charge point used. The table below shows the Uber Driver charge rates compared to bp pulse Pay as You Go Rates and Subscriber Rates:-

3.3 Offer 1 cannot be exchanged for cash.

3.4 Offer 1 is not negotiable and cannot be transferred to any other person or entity.

3.5 To the extent applicable, the usual bp pulse network terms and conditions will apply to Offer 1. Where there is a conflict between the usual bp pulse network terms and conditions and these terms and conditions, these terms and conditions will take precedence.

3.6 Eligible Uber Driver Customers will see the Subscription and any Discount Rate (in the form of applied bill credits) on their invoice after the end of their billing cycle.

4. How to take part

4.1 To receive the Subscription, Eligible Uber Driver Customers must have an active bp pulse subscription and have completed authentication by pairing their bp pulse account with their Uber account, meaning bp pulse has applied an Uber tag to the driver's account.

4.2 To receive the Discount Rate, the Eligible Uber Driver Customer must charge on the UK bp pulse public network, within their monthly billing cycle (starting at 00:00 on Day 1 and ending at 23:59 on the final day of their billing cycle).

4.3 The Discount Rate will be provided in the form of a bill credit automatically applied to the Eligible Uber Driver Customer’s bill on the first day of their next billing cycle.

5. Eligibility

5.1 To use this Offer 1, a driver must have an Eligible Uber Driver account authenticated with their bp pulse account in accordance with Uber’s General Terms and Conditions.

5.2 The status of the driver’s Uber Driver account will be checked regularly by bp pulse throughout the Term. If the driver’s Uber Driver account is no longer in ‘Active’ status when bp pulse make the check (i.e. the driver is not able to Go Online and take trips), then the driver will not be eligible for Offer 1. If the driver can demonstrate their status was not ‘Active’ for a short term and temporary reason when the status check was made, the driver should contact Uber Support by going to the Help section of the Uber Driver app, after which Uber will review the driver’s eligibility.

5.3 If the driver’s Uber Driver account permanently falls out of ‘Active’ status i.e. the driver is permanently removed from the Uber platform by Uber in line with Uber’s Driver Terms and no longer able to Go Online and take trips, a driver will no longer be eligible for Offer 1 and bp pulse will remove the driver from receiving the benefits of Offer 1, effective from when the status change is identified by bp pulse.

5.4 Eligible Uber Driver Customers are automatically enrolled.

6. Exclusions

6.1 Charging on any bp pulse charge points outside of the UK or free vend chargers, is excluded from the overall monthly consumption calculation and will not be counted towards Discount Rate.

6.2 Some third-party chargers (chargers that are branded bp pulse but not owned by bp pulse) may have different Pay As You Go and subscription pricing but a credit may still be applied for Eligible Uber Driver Customers. A list of these third-party chargers can be found here.

6.3 Offer 1 is limited to a maximum of £600 worth of billing credit that can be applied in a single billing cycle.

6.4 Any credit unrelated to Offer 1 or Offer 2 at the end of a billing cycle will not result in cash to the Eligible Uber Driver customer and will remain on the account until further usage consumes the credit.

6.5 If an Eligible Uber Driver Customer is in arrears with paying their bill, bp pulse reserves the right to remove the Offer set out above.

6.6 bp pulse will not be liable for costs incurred beyond what is stated in this T&Cs. Insofar as is permitted by law, bp pulse will not take any responsibility with regard to personal damage, loss of property, injury, loss or damage or be liable to compensate an Eligible Uber Driver Customer, or accept any liability whatsoever, under these terms and conditions, including (without limitation) any such liability arising by association of the Eligible Uber Driver Customers’ use of this offer.

7. Confidentiality

7.1 The terms of this offer, including but not limited to details regarding Offer 1, are to be held as confidential and must not be given or disclosed in any form to any third party without the prior written consent of bp pulse.

7.2 A failure to comply with the confidentiality provisions of this offer may result in the withdrawal of Offer 1, as determined by bp pulse in its sole discretion.

Offer 2 Charging Offer terms and conditions

1. The Promoter

The promoter is: Chargemaster Limited Ltd (trading as bp pulse), Breckland, Linford Wood, Milton Keynes, Buckinghamshire, MK14 6GY (“bp pulse”).

2. The Term

2.1 The Charging Offer (defined in section 3 as “Offer 2”) will run from 21 May 2024 at 00:01 and close on 21 May 2025 at 23:59 (“Term”). This offer will be available to the current bp pulse subscribers, and the first 8,000 new bp pulse subscribers (drivers signed up and subscribed on or after 21st of May 2024) during the Term. The offer shall be subject to availability and bp pulse reserves the right to withdraw the offer at its sole discretion by providing reasonable prior written notice to the Eligible Uber Driver to take effect at the end of the three-month term of Offer 2. In the case of Eligible Uber drivers who have already qualified for Offer 2, they will continue to be eligible for it, for up to a maximum of three consecutive months. The offer starts automatically for existing Eligible Uber Driver Customers upon the first day of their next billing cycle following 21st May 2024 and will run for a maximum of three consecutive billing cycles from that date. New Eligible Uber Driver Customers will automatically become eligible for three consecutive billing cycles as soon as their subscription is active and their Uber status is validated. If, however, Offer 2 is withdrawn before the New Eligible Uber Driver Customers’ subscription is active and their Uber status validated, they will no longer be eligible for the offer.

3. The Charging Offer (Offer 2)

3.1 Throughout the Term, and subject to these terms and conditions, the Eligible Uber Driver Customer will receive a credit of up to £250 applied to total kWh charge consumption using the paid-for UK bp pulse owned public charging network per monthly billing cycle for three consecutive months (“Offer 2”). The table below shows the Uber Driver charge rates associated with this offer.

The maximum credit an Eligible Uber Driver Customer can receive over three consecutive billing cycles is up to £750.

The monthly charging credits will be applied at the end of each billing cycle and matched to the amount spent by the driver (maximum of £250 of charging credits available per month).

4. Eligibility

4.1 To use this Offer 2, a driver must have an Eligible Uber Driver account authenticated with their bp pulse account in accordance with Uber’s General Terms and Conditions.

4.2 The status of the Uber Driver account will be checked regularly by bp pulse throughout the Term. If the driver’s Uber Driver account is no longer in ‘Active’ status when bp pulse make the check (i.e. the driver is not able to Go Online and take trips), then the driver will not be eligible for the offer. If the driver can demonstrate their status was not ‘Active’ for a short term and temporary reason when the status check was made, the driver should contact Uber Support by going to the Help section of the Uber Driver app, after which Uber will review the driver’s eligibility.

4.3 If the Uber Driver’s account permanently falls out of ‘Active’ status i.e. the driver is permanently removed from the Uber platform by Uber in line with Uber’s Driver Terms, and no longer able to Go Online and take trips, a driver will no longer be eligible for Offer 2 and bp pulse will remove the driver from receiving the benefits of Offer 2, effective from when the status change is identified by bp pulse.

4.4 To receive Offer 2 the Eligible Uber Driver must charge on the UK bp pulse public network, within their monthly billing cycle (starting at 00:00 on Day 1 and ending at 23:59 on the final day of their billing cycle).

4.5 Eligibility will be verified monthly on the billing anniversary date before credit is applied. Any unused credit will not be carried forward.

4.6 In the event the Eligible Uber Driver Customer is also using Offer 1, the rates within Offer 2 shall apply (up to £250 per billing cycle for up to three consecutive months) and supersede the Discount Offer rates.

4.7 This Offer 2 is subject to availability and may be withdrawn at the sole discretion of bp pulse in accordance with Clause 2.1 above the offer may also be extended at any time.

5. Limitation of liability

5.1 bp pulse will not be liable for costs incurred beyond what is stated in this T&Cs.

Insofar as is permitted by law, bp pulse will not take any responsibility with regard to personal damage, loss of property, injury, loss or damage or be liable to compensate an Eligible Uber Driver Customer, or accept any liability whatsoever, under these terms and conditions, including (without limitation) any such liability arising by association of the Eligible Uber Driver Customers’ use of this offer.

Car park and charging hub terms and conditions

1. Park Lane and Pimlico rapid charging hub access

1.1 Registered Uber drivers who scan their bp pulse card upon entering the car park (Eligible Uber Driver Customers) get free parking for 60 minutes at Q-Park Park Lane and Q-Park Pimlico car park. All existing eligible Uber Driver Customers should already have access granted via their bp pulse card. Any new Eligible Uber Driver Customer will automatically have access granted within 10 working days of their subscription becoming active.

1.3 By making use of the car park, the Eligible Uber Driver Customer accepts and acknowledges that their access to and use of the car park is subject to the Q-Park General Car Park Terms and Conditions, as set out on their website.

2.1 Insofar as is permitted by law, bp pulse, its agents or distributors will not in any circumstances be responsible or liable to compensate an Eligible Uber Driver Customer, or accept any liability whatsoever, under these terms and conditions, including (without limitation) any such liability arising by virtue of the Eligible Uber Driver Customers’ use of the Q-Park car park.

2.2 Nothing in clause 2.1 above limits an Eligible Uber Driver Customer’s statutory rights.

The Uber driver rewards programme (‘the Programme’) will run from 1 August to midnight on 31 October 2024. The Programme is open to: (i) all existing uber x bp pulse subscribers who are already signed up and are an eligible Uber driver in accordance with Uber’s Driver Terms (who will be automatically be enrolled for it) and ii) new eligible Uber drivers, as soon as their subscription is active, and their Uber status is validated and active.

To qualify for the chance to win a prize, eligible drivers must charge at least 8 sessions per calendar month.

At the end of each month, the drivers who have charged the most kilowatt hours (kWh) in that month (over a minimum of 8 sessions) will be awarded prizes based on the number of kilowatt hours (kWh) charged in descending order, as set out below. Eligibility for the Programme will be verified at the end of each month.

The monthly prizes available are:

1 x pair of Tottenham Hotspur Football club tickets (Men or Women’s team) - awarded to the highest charging driver in that month.

1 x pair of bp pulse live tickets (NEC in Birmingham) to a concert of their choosing - awarded to the second highest charging driver in that month.

5 x £50 Amazon gift vouchers – awarded to the third to seventh highest charging drivers in that month.

10 x car cleaning kits – awarded to the eighth to seventeenth highest charging drivers in that month.

All travel and expenses will be at the winners’ cost, there are no substitutes of prizes and tickets cannot be transferred to another party. Winners will be notified by email within 14 days of the end of the previous month (August, winners will be notified no later than14 September). If a prize is not claimed within 21 days of the driver being notified, the prize will be forfeited and bp pulse will be entitled to select another winner. Claimed prizes will be sent to winners within 28 days of notification. All prizes are subject to availability, non-transferable and there are no cash or prize alternatives available. For promotional purposes and with the winners' consent, the promoter may publish details of the winners and take photographs of the winners and their prizes at an award ceremony to be used in the promoter's future marketing communications.

Your statutory rights are not affected. The decision of the promoter regarding any aspect of awarding these prizes is final and binding and no correspondence will be entered into about it. Participating drivers are deemed to have accepted and agreed to these terms and conditions by being enrolled into the Programme.

bp pulse reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions. bp pulse reserves the right to hold void, cancel, suspend, or amend the Programme at its sole discretion where it becomes necessary to do so.

Insofar as is permitted by law, bp pulse will not take any responsibility with regard to personal damage, loss of property, injury, loss or damage or be liable to compensate an Eligible Uber Driver Customer, or accept any liability whatsoever, under these terms and conditions, including (without limitation) any such liability arising by association of the Eligible Uber drivers’ use of the Programme.
